These Terms of Service govern your use of AusTravla, operated by Cypaction Pty Limited. By accessing or using AusTravla you agree to these Terms and to our Privacy Policy.

0. Current state — please read

AusTravla is not yet launched ("coming soon"). Today the public website lets you register interest (give us an email to be notified at launch). The account, contribution, and other app features described below are still in development and are switched on progressively. A feature that is not yet live does not apply until it is switched on.

1. Acceptance of these Terms

By accessing or using AusTravla (the app or the website), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use AusTravla. If you use AusTravla on behalf of a business, you agree to these Terms on that business's behalf.

2. Eligibility

You must be able to form a legally binding contract to use AusTravla, and you must comply with all laws that apply to you. AusTravla is intended for use in Australia. Because families may use the app, people under 18 may access it; additional protections and restrictions may apply to under-18 users.

3. What AusTravla is

AusTravla is a free-for-travellers Australian camping and traveller-resource service. It helps you find, assess, contribute to and review camping spots and traveller services, using a mix of open data, community contributions, and (later) verified business listings. AusTravla is ad-free: we do not show third-party banner advertising, and we monetise on the supply side only (for example paid business listings). Some features referred to in these Terms are not yet available and will be switched on over time.

4. Your account

To contribute, you will need an account. You are responsible for keeping your login details secure and for activity that occurs under your account. Tell us promptly if you believe your account has been compromised. Sign-in is expected to be available by email/password, Sign in with Apple, and Google sign-in. Your handle/username and public profile are visible to other users.

5. Acceptable use

When you use AusTravla, you must not:

  • post content that is unlawful, defamatory, misleading, harassing, abusive, obscene, or that infringes anyone's rights;
  • post another person's personal information without the right to do so (for example a clearly readable number plate or an identifiable person's image without any required consent);
  • impersonate anyone, or misrepresent a business you do not own or are not authorised to represent;
  • scrape, harvest, overload, or interfere with the service or its data, or bypass security or access controls; or
  • use AusTravla for any unlawful purpose.

We may remove content and suspend or restrict accounts that breach these Terms (see section 14).

6. User content and community contributions

"User content" means anything you submit to AusTravla — including suggested edits and confirmations to listings, ratings, comments, reports/flags, profile and rig details, and (once the feature is enabled) photos.

You are responsible for your user content. You must have the right to submit it, and it must comply with section 5 and section 7.

Community contributions are user-generated and are not verified by us. Information contributed by the community reflects the views and input of users, not us. We do not check or guarantee it, except where a listing is separately marked "verified". "Verified" is a business/trust status, not a statement that the content is current or accurate: it is granted only (a) automatically to a paid business listing once the business completes payment, after which that business can manage its own listing, or (b) by an admin for free/national-park/community listings once details are confirmed. Approving a community edit updates a listing's freshness (its "last verified" date) — it does not make the listing "verified".

We may provide, and you agree to use in good faith, tools to flag/report content, and we operate a moderation process. For businesses, we intend to provide a right of reply and a takedown/complaints process.

7. Licence you grant us for your content

You keep ownership. You keep all copyright and other rights you already have in your user content. These Terms do not transfer ownership to us.

Licence. By submitting user content, you grant Cypaction Pty Limited (and our related bodies corporate and sub-contractors) a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, resize, compress, adapt (for example to create thumbnails, optimise delivery, and — for photos — strip metadata), publish, communicate, display and distribute your user content for the purposes of operating, promoting and improving AusTravla and our services, including displaying it on the relevant listing, rig or comment and in related app and marketing materials. We may also use de-identified or aggregated versions.

Your promises (warranties). You promise that, for each item of your user content: (i) you created it or otherwise own or control all rights needed to grant this licence; (ii) it does not infringe anyone's copyright, trade mark, or other rights; (iii) it is not unlawful and does not contain illegal, abusive, defamatory, misleading or sexually explicit content, and does not depict a child in any unsafe, exploitative or sexualised way; (iv) you have any consent required from people who are identifiable in it (and from the parent/guardian of any child shown); and (v) it does not contain another person's personal information that you are not entitled to share.

Deleting your content. You can delete your user content, which removes it from the live app. We may retain de-identified or aggregated data, secure backups for a limited period, and any copies the law requires us to keep.

Moral rights (Copyright Act 1968 (Cth)). Where you are the author, you consent (to the extent permitted by the Copyright Act 1968 (Cth)) to us using your content as described above, including reasonable edits (resizing, compression, cropping, metadata removal) and use without attribution.

8. Reviews and ratings

Reviews and ratings must be genuine, based on your real experience, and not misleading. Do not post fake, incentivised, or malicious reviews. For business/supplier reviews, we may ask for reasonable substantiation if a review is challenged.

9. Information accuracy — "know before you go"

AusTravla is a guide, not a guarantee. Much of the information comes from open data and the community, and conditions change — access, road and track conditions, weather, closures, availability, fees, and safety information may be inaccurate, incomplete, or out of date.

You must check current conditions with official and authoritative sources before you rely on them — especially for anything affecting safety, remote or four-wheel-drive travel, vehicle access, water crossings, fire and weather. You travel and camp at your own risk and are responsible for your own decisions, safety, and compliance with local rules, permits and closures. This reflects our tagline — know before you go.

Nothing in this section is intended to exclude, restrict or modify any rights you have that cannot be excluded under the Australian Consumer Law (see section 10).

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that the ACL gives you and that cannot lawfully be excluded. If you are a "consumer" under the ACL, you may be entitled to remedies (such as a refund, repair or compensation) that these Terms do not take away.

The disclaimers and the limitation of liability in these Terms apply only to the extent permitted by law and are subject to the ACL consumer guarantees.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, and subject to section 10 (Australian Consumer Law):

  • AusTravla is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that the information in it is accurate, complete, current, or fit for a particular purpose (see section 9).
  • We are not liable for any loss or damage arising from your use of, or reliance on, AusTravla or its content, including information about access, routes, weather, or safety, or from other users' content or conduct.
  • Where our liability cannot be excluded but can be limited, our liability is limited (at our option, to the extent the law allows) to re-supplying the relevant service or paying the cost of having it re-supplied.

None of the above limits any liability that cannot be limited or excluded under the ACL or other applicable law.

12. Third-party data and attribution

AusTravla includes data seeded from OpenStreetMap © OpenStreetMap contributors, made available under the Open Database Licence (ODbL), and from Australian government open data (mostly under Creative Commons Attribution / CC BY), used under those licences with attribution. Those datasets remain subject to their own licence terms.

13. Intellectual property

Except for your user content and third-party data (sections 7 and 12), AusTravla — including the "AusTravla" name and brand, the software, design, and our materials — is owned by or licensed to Cypaction Pty Limited. You may not copy, modify, distribute, or create derivative works from it except as these Terms or the law allow.

14. Suspension and termination

We may suspend, restrict, or terminate your access to AusTravla if you breach these Terms, or where we reasonably need to for legal, security, or operational reasons. You may stop using AusTravla and close your account at any time. Sections that by their nature should survive termination (including sections 7, 9, 10, 11, and 13) continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. If we make a material change we will take reasonable steps to notify you (for example in-app or on the website). Your continued use after a change takes effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
